Terms of Use

These Terms of Use (“Terms”) govern your use of the online price-estimator pages operated by Big D & AI LLC (“Big D & AI,” “we,” “us”) on behalf of local home-improvement businesses. By using an estimator, you agree to these Terms. If you do not agree, please do not use the estimator.

1. What the estimator is

The estimator is a free, self-service tool that gives you an instant, informational price range for a home-improvement project based on the answers you provide and pricing configured by a local business (the “Business”). It is a convenience — it is not a booking system, a payment system, or professional advice.

Your estimate is not a quote or a contract. The range shown is a good-faith estimate only. It is not an offer, a binding price, a guarantee, or a promise that any work will be performed at that price. Actual pricing depends on an in-person assessment and exact measurements, and is confirmed only in a written proposal from the Business. Estimates may be inaccurate or out of date, and either you or the Business may decline to proceed.

2. No professional relationship

Using the estimator does not create a contractor, professional, agency, or employment relationship between you and Big D & AI. Big D & AI does not perform home-improvement work and is not a party to any agreement you may later enter with a Business. The Business is independent and is solely responsible for the work it performs and the quotes it provides.

3. Connecting you with a local business

If you choose to share your contact details or request a visit, you authorize us to pass your information to the relevant Business (or, if you are outside its area, to the nearest participating Business) so it can follow up. How the Business contacts and serves you is governed by that Business and by our Privacy Policy.

4. Your responsibilities

Provide accurate information and use the estimator only for a genuine, lawful home-improvement inquiry.
Do not misuse the estimator — no automated scraping, overloading, probing, reverse-engineering, or interfering with the service or its security.
Do not submit false, spam, or someone else’s information without permission.
You must be at least 18 years old to submit a request.

5. Intellectual property

The estimator software, design, text, and branding are owned by Big D & AI or its licensors (the Business owns its own brand). You may use the estimator for your personal, non-commercial home-improvement inquiry only. You may not copy, resell, or create derivative works from the service.

6. Third-party links and services

The estimator may link to third-party sites or rely on third-party services (for example, hosting, analytics, and messaging providers). We are not responsible for third-party content or practices; their terms and privacy policies apply to them.

7. Disclaimers

THE ESTIMATOR AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY ESTIMATE IS ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIG D & AI AND ITS OWNERS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE ESTIMATOR OR ANY RELIANCE ON AN ESTIMATE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE ESTIMATOR WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify and hold harmless Big D & AI and its owners, affiliates, and service providers from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the estimator or your violation of these Terms or applicable law.

10. Changes and availability

We may modify, suspend, or discontinue the estimator, and may update these Terms, at any time. Material changes take effect when we post the updated Terms with a new “Effective” date. Your continued use after changes means you accept them.

11. Severability; entire agreement

If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be limited to the minimum extent necessary. These Terms are the entire agreement between you and Big D & AI regarding the estimator and supersede any prior understandings. Our failure to enforce a provision is not a waiver.

12. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Ohio, unless applicable law requires otherwise.
